If you breach these Terms of Service, we reserve the right to take appropriate action against you, which may include, but is not limited to, suspending or terminating your account and access to the Services. Any violations may result in immediate consequences at our discretion, without prior notice, to ensure the integrity and security of the Services and the experience of other users.

To provide the services, we need information about you, and we only use your information where we have a legal basis to do so. This will help you understand how we handle your personal data and the rights you have while using our Services.

Persons under the age of 13 are not permitted to use the Services. Individuals between the ages of 13 and 18 require the consent of their parents or legal guardians ("Parents") to access and use our Services. Parents can provide and verify their consent either through the game or via another authorized third-party provider available through the Service.

We strongly recommend that parents monitor their child's online activity and usage of the Service. If a parent wishes to withdraw their previously given consent for their child's access to and use of the Services, they should disconnect the child's account from our Services.

f. You agree not to cheat, hack or make any attack on the server in any way;

g. You agree not to transmit or make any advertising, promotional materials or any other forms of solicitation;

h. You agree not to transmit any material that contains viruses, worms, traps or malicious computer code;

i. You agree not to disrupt the normal flow of the application and dialogue, or otherwise act in a manner that negatively affects other people's ability to use the Service;

j. You agree not to collect, process or store personal data about other people using the Service;

k. You agree only to use your own credit card with the Service; and

l. You agree not to use any of our trademark, service mark or tradename, or any variation or misspelling thereof.

We may directly terminate or suspend your access to the Services, at our sole discretion, at any time and without notice to you, including if (a) you fail to comply with these Terms of Service; (b) we suspect fraud, cheating, or misuse by you; or (c) we suspect any other unlawful activity associated with your behavior under mobile application.

5.1 VIRTUAL ITEMS

You may purchase virtual currencies with "real world" money, including but not limited to virtual cash, in-game coins, and other types of in-game currency, all for use within the games. These virtual currencies can be used to acquire:

(a) virtual in-game items (referred to collectively with virtual currencies as "Virtual Items"); and

(b) other goods or services within the Services for your personal, non-commercial entertainment.

You are only permitted to purchase Virtual Items through our authorized partners and not through any other methods.

All rights, titles, and interests in the Services (including, but not limited to, any games, applications, titles, computer code, themes, objects, characters, names, dialogue, catchphrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, moral rights, documentation, in-game chat transcripts, and server software) are owned by or licensed to us, and are protected by copyright and other intellectual property rights under applicable laws and international conventions.

You acknowledge that we have the exclusive right to manage, regulate, control, modify, or remove Virtual Items at our discretion, and we may revoke your access to them at any time, for any reason, with or without notice. We are not liable to you or any third party for the exercise of these rights. You have no claim, right, title, or ownership interest in any Virtual Items, regardless of any payment made for them.

Except when explicitly authorized by us, the following actions are strictly prohibited:

(i) the transfer of Virtual Items to other users;

(ii) the buying, selling, or exchanging of Virtual Items for "real world" money or any other form of value outside the Services; and

(iii) we do not recognize or permit any purported transfers of Virtual Items or the sale, gifting, or trading of items from the Services in the "real world."

Any attempt to engage in the actions mentioned above is a violation of these Terms of Service and will result in an automatic termination of your rights to use Virtual Items. Such actions may also lead to the termination of your account.

Please note that all Virtual Items will be forfeited if your account is terminated or suspended for any reason, or if we cease providing the Services.

You agree that you will not assert or bring any claim against us, our affiliates, directors, officers, employees, agents, service providers, or licensors relating to:

(i) any claim that you own any Virtual Items; or

(ii) any claim regarding the alleged monetary value of Virtual Items lost due to the deletion or suspension of your account, or due to any modification, termination, or expiration of these Terms.

We own and hold an exclusive license to all content within the mobile application Sea of Survival. As such, no one other than us has the right to sell any game content or mobile application related to Sea of Survival in any manner. Additionally, you are prohibited from selling in-game items for real money or exchanging virtual currency items outside of our game or mobile applications.

YOU ACKNOWLEDGE THAT YOU HAVE NO PROPERTY RIGHTS WHATSOEVER IN VIRTUAL CURRENCY ITEMS. Furthermore, you acknowledge that virtual currency is only to be used within the context of our games or mobile applications and cannot be used for any other purpose.

5.2 FEES, REFUNDS AND RETURN POLICY

All sales through the Service are final. You acknowledge and agree that any applicable fees and other charges (including, without limitation, virtual items) are not refundable in whole or in part. You are fully liable for all charges to your account, including but not limited to any unauthorized charges. We do not issue any refunds or offer any exchanges of any products purchased on or through the Services.

IN ADDITION TO FOREGOING, YOU ACKNOWLEDGE THAT, EXCEPT AS OTHERWISE SET FORTH UNDER PUBLICABLE LAW, YOU WILL NOT BE REFUNDED, RECEIVE MONEY, OR BE OTHERWISE COMPENSATED FOR UNUSED VIRTUAL ITEMS OR OTHER GAME ASSETS WHEN THE SERVICES ARE TERMINATED FOR ANY REASON AND WITHOUT NOTE OR AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

We may, at any time, amend the pricing, availability, specifications, content, descriptions, or features of the game and mobile application, or any products sold through the Services. The inclusion of any products through the Services at a particular time does not imply or guarantee that these products will be available at any other time. All such changes will be effective immediately upon posting the updated product prices to the Services.

We impose certain restrictions on your permissible use of the game and the service. You are prohibited from violating or attempting to violate any security features of the game or service, including, without limitation,

a. accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access;

b. attempting to probe, scan, or test the vulnerability of the Service, the Site, or any associated system or network, or to breach security or authentication measures without proper authorization;

c. interfering or attempting to interfere with service to any user, host, or network, including, without limitation, by means of submitting a virus to the game or service, overloading, "flooding," "spamming," "mail bombing," or "crashing;"

d. using the game or service to send unsolicited e-mail, including, without limitation, promotions, or advertisements for products or services;

e. forging any packet header or any part of the header information in any e-mail or in any posting using the Service;

f. attempting to modify, reverse-engineer, decompile, disassemble, or otherwise reduce or attempt to reduce to a human-perceivable form any of the source code used by us in providing the game or service. Any violation of system or network security may subject you to civil and/or criminal liability.

Furthermore, you agree that you will not (1) modify or cause any files that are a part of the game of ours; (2) create or use cheats, "mods", and/or hacks, or any other third-party software designed to modify the experience of games of ours; (3) use any third-party software that intercepts, "mines", or otherwise collects information from or through a game of ours.

When accessing the game or using the Service, you agree to obey the local law, general principles of law and to respect the intellectual property rights of others. Your use of the Service and the game is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content (collectively, "Content") in violation of any third party's copyrights, trademarks, or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third-party rights caused by any Content you provide or transmit, or that is provided or transmitted using your User ID. The burden of proving that any Content does not violate any laws or third-party rights rests solely with you. Additionally, in the event that you become aware of or reasonably suspect any infringement of the copyrights or trademarks or any third parties, occurring on any our game, you will immediately notify us to report such infringement. You agree not to upload, download, display, perform, transmit, or otherwise distribute any Content that (a) is libellous, defamatory, obscene, pornographic, abusive, or threatening; or (b) violates any applicable local, state, national, or foreign law or regulation under chat sessions. We reserve the right to terminate your receipt, transmission, or other distribution of any such material using the Service, and, if applicable, to delete any such material from its servers. We intend to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Service or of any applicable laws.

7.2 LICENSE TO USE THE SERVICES

c. Modify or cause any files that are part of the Service, or any of our games and mobile applications, to be altered without our express written consent.

d. Attempt to gain unauthorized access to the Service, accounts registered to others, or the computers, servers, or networks connected to the Service, through any means other than the user interface provided by us. This includes, but is not limited to, circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting others in circumventing or modifying any security, technology, device, or software that is part of the Service.

We reserve the right to determine what conduct violates these Terms of Service or goes against the intent and spirit of the Service. If necessary, we will take appropriate action, which may include terminating your account and prohibiting you from using the Service, in whole or in part.

WITHOUT LIMITING OUR OTHER REMEDIES, WE MAY LIMIT, SUSPEND OR TERMINATE THE SERVICE AND USER ACCOUNTS OR PORTIONS THEREOF, PROHIBIT ACCESS TO OUR MOBILE APPLICATION, GAMES AND THEIR CONTENT, SERVICES AND TOOLS, DELAY OR REMOVE HOSTED CONTENT, AND TAKE TECHNICAL AND LEGAL STEPS TO PREVENT USERS FROM ACCESSING THE SERVICE IF WE BELIEVE THAT THEY ARE CREATING RISK OR POSSIBLE LEGAL LIABILITIES, INFRINGING THE INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, OR ACTING INCONSISTENTLY WITH THE LETTER OR SPIRIT OF OUR TERMS OR POLICIES. ADDITIONALLY, WE MAY, IN APPROPRIATE CIRCUMSTANCES AND AT OUR SOLE DISCRETION, SUSPEND OR TERMINATE ACCOUNTS OF USERS WHO MAY BE REPEAT INFRINGERS OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS.

Our policy mandates the immediate suspension and/or termination of any user found to have infringed on our rights or the rights of a third party, or who has otherwise violated intellectual property laws or regulations. NOTHING IN THESE TERMS OF SERVICE SHOULD AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR EXCLUDE OR RESTRICT ANY LIABILITY RESULTING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF US.

You agree to indemnify, defend and hold us harmless from any claim, demand, damages or other losses, including reasonable attorneys' fees, asserted by any third-party resulting from or arising out of your use of the Service, or any breach by you of these Terms of Service. You hereby acknowledge that by using the game or the Services, you do not acquire any property rights whatsoever in the game, the Services, Game Data (as defined below), or any status within the game or Services. Playing games created by us requires the creation and retention of electronic files, including, but not limited to, player characters, accounts, in-game virtual currency, statistics, user profiles, etc. ("Game Data"), which are stored by us. While safeguarding Game Data is a priority for us, please note that we shall not be liable for the loss of any Game Data for any reason whatsoever.

Specifically, regarding all our virtual in-game currencies, YOU HEREBY ACKNOWLEDGE THAT BY PURCHASING OR OTHERWISE OBTAINING IN-GAME CURRENCIES YOU DO NOT ACQUIRE ANY PROPERTY RIGHTS WHATSOEVER IN THE IN-GAME CURRENCIES. WE IN-GAME CURRENCIES ARE GAME DATA THAT ARE INTEGRAL TO WE PROVIDING ENTERTAINMENT SERVICES TO ITS USERS.

You agree to indemnify us for certain of your acts and omissions. You agree to indemnify, defend, and hold harmless us from any and all third party claims, losses, liability, damages, and/or costs (including but not limited to all attorney fees and costs) arising from your access to or use of the service, your violation of these Terms of Service, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. All GAME code and shockwave files associated with the game or service are saved in the US.
